Concern about the Big 12 in 2012
Ok, I do not know if anyone has noticed or not, but the SEC has released a schedule for the 2012 football season that includes Missouri. I also noticed that a judge in Rhode Island has recently denied West Virginia's motion to have the Big East's case against it dropped. Now it is my understanding that if the Big 12 falls below 10 teams, that the television contracts are null and void. It was also my understanding that if West Virginia cannot exit the Big East and join the Big 12 in time for the 2012 season, that Missouri would be forced to remain in the Big 12 until that time. So what does that leave the Big 12? Are we at the mercy of the courts and the Big East, or are we going to be able to hold Missouri back? If we get those television contracts cancelled, we are screwed and the Longhorns will be laughing all the way to the bank.

Not THAT bad
1) Big East/West Virginia is still in the courts. The Big East have a stronger contract with their members leaving. West Virginia, still may join in 2012, or they may not. Breach of contract is usually settle with monetary damages, and NOT performance of the contract.
2) Missouri leaving: Big 12’s agreement is much, much weaker. Schools can buy their way out, which is what Missouri did
3) Fox contract, is NOT voided….it CAN be voided if Fox wanted too. They don’t want the 2nd tier for the Big 12 to go back to the open market. 1st tier (w/ ABC) is still ok
4) Where the Big 12 COULD be screwed is in scheduling. It’s getting late to schedule even MAC and D-II schools. Heard that Big 9 may have some teams play each other twice.
I would play OSU twice....
if they are both in Norman. Or Texas, once in Dallas and once in Norman.

Specific performance is absolutely an option. You are right that it’s not the resolution of most breach cases, but mostly because the breach occurred in the past. This is a case where specific performance could make a lot of sense, because it’s a future action.
Here’s an idea: how ‘bout WVU plays a full conference game in both conferences in 2012? That’s a mere two games each week in October and November. ;)

Has a court ever required specific performance in a situation like this?
I had always read that 100% of the time is was lots and lots of coin changing hands instead.
In any case, I am looking forward to the new blood within the conference. Never cared for anything aTm, and very glad the cheap B1G hooker of the conference Missouri is gone.

Hearing some internet rumors
that the Longhorn Network may get pulled, it hasn’t hit it’s goals and has triggered “contractual Outs”, for both sides. It was the stumbling block that kept UT out of the Pac 16 deal. I’m hearing Scott with the Pac-12 is dangling their Pac-12 deal to UT.
again…just internet rumors. UT and OU to the Pac-12 just makes too much sense. Cali and Texas schools and national brand Oklahoma would be a TV force. I’m not sure how much real legs this has though. Ultimately I’ll believe it when I see it. Will there even be a Big 12 for West Virginia to join?

While I would love to see the Longhorn Network....
go sailing on the FAILBOAT, I have gotten comfortable with the idea that the Big 12 could be saved. I would hate for the Pac 12 thing to come up again. Think about it, it will be a second fiddle thing for us again.

the LHN contract
has specific performance numbers (Live games/programming, distraction numbers) that if they aren’t meet either side can pull out and void the contract. The LHN isn’t close to hitting them, thus it could be canned by either party at this point.
The rumor is that Pac Commish Larry Scott, is saying in affect…“hey the LHN is a bust….but with our Pac12-TV deal you’d still get local station, all ready with more outlets, and far more money”
I doubt that ESPN would pull the contract after one year. I cannot imagine that they were naive enough to think that the network would turn a profit straight away. My guess is they’re in it for the long haul, at least two more years (through 2013). Don’t think Texas would pull the contract under any circumstances since it’s free cash for them.
I hope for the failure of LHN, But I cannot imagine that it’s dropped so soon.

I saw a couple of commentaries that the B1G/Pac12 thing would be expansion substitution with out the mess of expansion. Guess that’s the case.
So….Big 12…..hopefully we find good expansion candidates, and get our teams in soon.
